
HYBE failed to get Guilty Archive?
HYBE met a big obstacle on suing its enemy, ‘Guilty Archive,’ the user of ‘X.’
Seoul Wire reported on the 1st that the U.S. Court for the Northern District of California rejected HYBE’s request for information disclosure against users of X (formerly Twitter), ‘Guilty Archive’ on the 28th of last month (local time).
Earlier, HYBE announced a strong legal action against the Cyber Rumor spreading channels, which slanders its artists. HYBE announced that it has initiated legal proceedings against various cyber rumor spreading channels for defamation and obstruction of business, and said they will fight against overseas platforms users that they have difficulty identifying their personal information.
Among them, HYBE claimed that the user made false allegations such as “LE SSERAFIM is behind the disband of his girlfriend” and sued the X account. They said it spread false information such as the connection between BTS and Dahn world, for defamation, and applied to a U.S. court to identify the accused as X’s headquarters are located in the U.S.
However, the U.S. court rejected the request. “HYBE’s application meets the basic requirements of Article 1782, however the court does not allow disclosure of information,” said judge Vince Chhabria, who was in charge of the case. “If a Korean investigative agency requests disclosure of information on this case, we will be able to proceed according to the treaty between the U.S. and Korea,” he added.
So there is a chance to get the user information if they co-work with Korean Investigation center.
