
[Legal Expert] HYBE vs NewJeans Danielle 43.1 Billion KRW Lawsuit And The Possibility Of Astronomical Increases
Attorney Kim Jung-cheol of the law firm Woori has raised the possibility that NewJeans member Danielle could face legal penalties far exceeding 40 billion KRW. According to Kim, if the responsibility for the breach of contract lies with Danielle, the total damages could surpass initial estimates depending on the court final ruling.
Projected Revenue and the Impact of Penalty Clauses
The scale of the lawsuit is closely tied to ADOR revenue, which reached 110.3 billion KRW in 2023 and 111.1 billion KRW in 2024. With Danielle contract set to run until July 31 2029, Kim calculates that the projected revenue per member over the remaining period could approach nearly 100 billion KRW. Furthermore, the inclusion of penalties rather than just liquidated damages complicates the case, as these penalties are generally non deductible under standard contract law and can be several times the amount received by the artist.
Legal Liabilities for Danielle and Co-defendants
Following the announcement of Danielle contract termination, ADOR filed a lawsuit seeking approximately 43.1 billion KRW in damages. The agency stated it was no longer possible to continue working with Danielle as an artist and holds her, a family member, and former CEO Min Hee-jin accountable for the disruption. All three parties are named as defendants in the lawsuit, as ADOR seeks to determine legal responsibility for the financial losses and the withdrawal of the artist from the group.
